Have questions about estate planning? Find answers to some common queries below.

  1. What is a Lasting Power of Attorney and why do I need one?

      A LPA is a legal document that             allows you to appoint one or               more people you trust (called               your attorney) to make decisions         on your behalf, if you ever                     become unable to. 

      It gives you peace of mind, that           whatever happens in the future,           your wishes are respected and             your loved ones are able to step         in, without stress or delay.

2.  What types of LPA are there?

     There are two types of LPA.

      Property & Financial Affairs          LPA

     This type covers your money and        property, such as:

  • Managing bank accounts, savings & bills. 

  • Collecting benefits or pension payments. 

  • Selling or managing your home

  • Handling day-to-day financial matters

       Health & Welfare LPA

      This type covers personal &                  medical decisions, such as:

  • ​Where you live and the care you receive

  • Day-to-day decisions about diet, routine or activities

  • Medical treatment choices

  • Life sustaining treatment decisions (should you choose to give this authority

3. Do you give legal or financial advice?

No. We specialise in helping you complete and register LPAs. If you'd like advice on wills, trusts or tax planning, we can put you in touch with our trusted partners.

 

4.  How long does it take?

 

We prepare paperwork promptly. The Office of the Public Guardian usually takes several weeks to register LPAs and we'll keep you updated throughout.   

5.  Can I make an LPA for someone else?

You can't complete an LPA on behalf of someone else - the person making the LPA must have mental capacity and make their own choices. However, you can help them throughout the process and we will guide you both step-by-step. 

6.  What happens after my LPA is registered?

Once the Office of the Public Guardian has registered your LPA, you'll receive the official stamped documents. (We are happy to store these if needed). From there, your attorneys can use the LPA if needed and you can rest easy knowing everything in place.
